Terms of Service

1. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use the Service. By using the Service, you represent and warrant that you meet this requirement.

2. Account Registration

To use certain features of the Service, you must create an account and provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Description of Service

Post Guard AI is an email classification and filtering service. It connects to your email account via IMAP or authorized API access, analyzes incoming messages using artificial intelligence, and categorizes them (e.g., Safe, Newsletter, Promotional, Spam). Based on your preferences, the Service may move messages to designated folders or labels.

The Service does not store the content of your emails. Only message identifiers and classification metadata are retained to prevent duplicate processing and to provide statistics.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks connected to the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Use the Service to transmit any viruses, worms, or other malicious code.
• Resell, sublicense, or otherwise make the Service available to any third party without our prior written consent.

5. Email Credentials and Access

To provide the Service, you must supply your email account credentials (IMAP username and app password) or authorize access via OAuth. You acknowledge that:

• Your credentials are encrypted at rest and in transit.
• We access your email account solely for the purpose of classifying and managing messages according to your preferences.
• You may revoke access at any time by removing your mailbox from the Service or revoking OAuth permissions through your email provider.

6. Intellectual Property

The Service, including all software, algorithms, designs, text, graphics, logos, and trademarks, is the property of FairfieldTek L.L.C. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes in accordance with these Terms.

7. Payment and Subscriptions

Certain features of the Service may require a paid subscription. If you purchase a subscription:

• You agree to pay all fees associated with the plan you select.
• Payments are processed through third-party payment processors (e.g., PayPal). You agree to their terms of service as well.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Refunds are handled in accordance with our refund policy, if any, and applicable law.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy of email classifications, and you acknowledge that the AI-based classification may occasionally produce incorrect results.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAIRFIELDTEK L.L.C., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless FairfieldTek L.L.C. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us or by removing all configured mailboxes from the Service.

Sections 6, 8, 9, 10, 12, and 13 shall survive any termination of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FairfieldTek L.L.C. with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
